This website is operated by VERASCALE LLC, doing business as "Kova" ("Kova," "we," "us," or "our"), with a principal place of business at 8417 Bamboo Road, Fort Myers, FL 33967, United States. By visiting our site and/or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Refund Policy, our Shipping Policy, and, if applicable, our VIP Membership Terms — all of which are incorporated into these Terms by reference. If you do not agree to all of the Terms, you may not access the website or use any of our services.

We may update these Terms at any time by posting an updated version on this page. The "Last updated" date reflects the latest revision. Material changes are notified through the site or by email where appropriate. Your continued use of the site after a change constitutes acceptance.

2. Eligibility

You must be at least 18 years old to purchase from this site. By placing an order you represent that you are of legal age in your jurisdiction and that the payment method you use is yours and authorized.

3. Products & Health Disclaimer

Kova sells dietary supplements. These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Information on this site is for educational purposes only and is not a substitute for advice from your physician or other healthcare professional. Consult a qualified healthcare provider before starting any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.

4. Product Listings, Pricing & Availability

We make reasonable efforts to display product images, ingredients, and descriptions accurately, but we do not warrant that descriptions are error-free. Prices are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order, and to correct typographical or pricing errors at any time, including after an order has been submitted. If we cancel an order you have already paid for, we will issue a full refund.

5. Subscriptions & Auto-Renewing Memberships

Some Kova offerings are auto-renewing subscriptions, including product-specific "Subscribe & Save" plans and the Kova VIP Membership. By enrolling in a subscription you authorize us to charge your payment method on file on a recurring basis at the interval and amount disclosed at checkout, until you cancel.

5.1 Kova VIP Membership — specific disclosures

$39.95 per month: Your payment method is charged $39.95 on enrollment and $39.95 every 30 days thereafter, on the same calendar day each month, until you cancel. There is no free trial.
Benefits: 50% off all Kova supplements while active, early access to new drops, and members-only offers.
Cancel anytime — from your account page or by emailing support@trykova.shop. Cancellation must be received at least 48 hours before your next billing date to avoid the next charge. Cancelling stops future renewals; charges already processed are subject to the Refund Policy.

5.2 Other product subscriptions

If you enroll in a product-specific subscription (e.g., recurring shipments of Magnesium Complex), the same rules apply: clear pre-charge disclosure, cancel anytime, no cancellation fee.

5.3 Your acknowledgments

By clicking "Get VIP", "Subscribe", or any equivalent button at checkout you affirmatively consent to (a) the recurring billing terms shown on the order page, (b) the cancellation procedures described above and in our Refund Policy, and (c) receipt of an order confirmation that re-states these terms.

6. Payments

We accept the payment methods displayed at checkout. By submitting an order you represent that you are authorized to use the payment method provided. All charges are in U.S. dollars unless otherwise stated. Recurring charges are made by Kova or our payment processor and will appear on your statement as "KOVA" or a similar identifier.

7. Shipping & Risk of Loss

Shipping times are estimates and not guaranteed. Title and risk of loss pass to you on our delivery of the goods to the carrier. See our Shipping Policy for details.

8. Returns & Refunds

See our Refund Policy for full terms. Our 30-day money-back guarantee applies to first-time orders of a given product, subject to the conditions in the Refund Policy. VIP membership fees are subject to the VIP-specific refund rules in the Refund Policy.

9. Intellectual Property

All content on this site — including text, graphics, logos, the "Kova" wordmark, images, product photography, and software — is the property of Kova or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, scrape, or create derivative works without our prior written permission.

10. User Conduct

You agree not to use the site for any unlawful purpose, to interfere with its operation, to transmit malicious code, or to attempt unauthorized access to any portion of the site or its underlying systems.

11. Reviews & User Submissions

By submitting a review, photo, comment, social tag, or other content, you grant Kova a perpetual, royalty-free, irrevocable, worldwide, sublicensable license to use, reproduce, modify, and display that content for any commercial or non-commercial purpose, including marketing, in connection with Kova and its successors. You represent that the content is your own, accurate, and does not violate any third party's rights.

Reviews and testimonials reflect the individual experience of the reviewer and are not a guarantee of results. We honor the FTC Endorsement Guides: reviewers received the product they reviewed and have not been compensated unless explicitly disclosed.

12. Marketing Communications

If you opt in to marketing email or SMS, you may withdraw consent at any time (email: unsubscribe link in every message; SMS: reply STOP to any message; HELP for help). Standard message and data rates may apply. Frequency varies. We honor opt-outs promptly. See our Privacy Policy for details.

13. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Limitation of Liability

To the maximum extent permitted by law, Kova and its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability arising out of or relating to these Terms shall not exceed the amount you paid to us in the six (6) months prior to the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitations on incidental or consequential damages; the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Kova and its affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.

Informal resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting support@trykova.shop. We will attempt to resolve it within 30 days.

Binding arbitration; class action waiver. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration in Florida under the rules of the American Arbitration Association. You waive any right to participate in a class action, class arbitration, or representative action. Either party may bring a claim in small-claims court if it qualifies.

30-day opt-out. You may opt out of the arbitration agreement and class-action waiver by emailing support@trykova.shop with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms.

17. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, supplier failures, pandemic-related disruptions, governmental action, internet or carrier outages, or natural disasters.

18. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force. These Terms (together with the documents incorporated by reference) constitute the entire agreement between you and Kova regarding the Service and supersede any prior agreement.
